DESCRIPTION OF SERVICES
Jollibee Foods Corporation, (“We” or “JFC”) is the Personal Information Controller, as defined under Republic Act No. 10173 or the Data Privacy Act of 2012, responsible for ensuring the privacy of the personal information you provide using this online registration portal (the “Annual Stockholders' Meeting Portal”). As such Personal Information Controller, we shall process your personal information in accordance with the Data Privacy Act of 2012, its implementing rules and regulations, and this Privacy Policy.
A. WHAT WE COLLECT
To process your application for the registration for JFC’s Annual Stockholders’ Meeting (“ASM”) on Friday, June 28, 2024, we will be collecting the following personal information:
- Full name;
- Digital copy of your current photo with face clearly visible;
- Scanned clear copy of any of the following valid government-issued IDs: Passport, Driver’s License, Social Security System (SSS) or Government Service Insurance System (GSIS) Card, Unified Multi-Purpose ID (UMID) Card, Professional Regulation Commission (PRC) ID, COMELEC Voter’s ID, Senior Citizen’s ID, Solo Parent ID, Persons With Disability (PWD) ID;
- Email address;
- Mobile or landline number;
- Stock certificate number (if applicable);
- Broker’s certificate (if applicable);
- Complete address/principal office address (if applicable); and
- Clear scanned copy of company identification card or media/press identification card (for invitees other than stockholders).
For stockholders/guests who only wish to attend the live streaming of the ASM by clicking the “Register for Webinar Only” link, we will be collecting the following personal information to process your registration:
- Full name;
- Email address;
- Company Name;
- Position.
If you are providing information pertaining to and/or on behalf of a third-party, we assume that you have obtained the permission of the relevant third-party to share their information with us through the ASM Portal. You understand and agree that JFC will not be responsible for obtaining such consent and/or for any liability which may arise in the absence of such consent. For joint accounts, we shall also require the submission of a Special Power of Attorney which may be uploaded in the relevant portion of the ASM Portal.
B. HOW WE COLLECT
We collect these personal information once you register and create an account with us through the ASM Portal. Some parts of the registration process will also require you to upload copies of identification cards and other personal documents. By giving us your personal information, you understand and agree that we shall use your personal information in accordance with this Privacy Policy.
C. WHAT WE DO WITH THE INFORMATION WE GATHER
We will process the information we have collected from you, and on the assumption that you have obtained the consent of the third-party, for the following purposes:
- To send important communications and notices regarding your ASM registration, when accepted;
- To validate the information provided for registration purposes in order for you to access the voting in absentia mechanism, send questions on the agenda items of the ASM, and access the link to the livestream of the ASM;
- To validate your access to the livestreaming of the ASM;
- To validate votes made during the ASM; and
- For stockholders with certificated shares, to update your email and contact number in the records of the accredited stock transfer office
D. DISCLOSURE OF INFORMATION
We will disclose your personal information to our accredited stock transfer office as designated by the Company for purposes of validation of registration and voting tabulation for JFC’s ASM for 2021, and for updating your email and contact number in their records, as stated in Section C above.
Your information will not be shared to our accredited stock transfer office for their marketing initiatives or purposes other than what is stipulated above. This partner is required to protect your personal information through the relevant documentary undertakings.
We will not share your personal information to third parties other than those stated above, unless we have your permission or are required by law to do so.
E. SECURITY STORAGE AND DISPOSAL
We are committed to ensuring that we securely collect and store your personal information. To prevent unauthorized access, processing or disclosure of your personal information, we have put in place suitable physical, electronic and organizational procedures to safeguard and secure the personal information we collect online such as but not limited to data encryption and access restrictions on our databases.
We store your personal information in an authorized third party’s secured servers which may be accessed by our accredited partners for the purposes stated above. We shall retain the personal information and documents up to five (5) days from the date of the ASM or any postponement or adjournment thereof. At the end of such retention period, we shall dispose of your personal information in accordance with the relevant privacy rules and our internal guidelines.
Tabulation of votes made during the ASM will be retained by us through a back-up drive and will be kept for as long as necessary. For clarity, the retained tabulated votes do not include personal information.
F. HOW WE USE COOKIES
A cookie is a small file which asks permission to be placed on your computer's hard drive. Once you agree, the file is added, and the cookie helps analyze web traffic or lets you know when you visit a site. Cookies allow web applications to respond to you as an individual. The web application can tailor its operations to your needs, likes and dislikes by gathering and remembering information about your preferences.
We use traffic log cookies to identify which pages are being used. This helps us analyze data about web page traffic and improve our website in order to tailor it to customer needs. We only use this information for statistical analysis purposes and then the data is removed from the system. If you however want to delete cookies from your browser or device we suggest that you use the option to delete cookies and other site and plug-in data, including data stored on your device from your browser settings normally found in browsing history.
Overall, cookies help us provide you with a better website by enabling us to monitor which pages you find useful or not. G. UPDATING THIS PRIVACY POLICY
Whenever necessary, we may, from time to time, update and/or revise this Privacy Policy. We shall inform you of such update or revision by placing the date of the latest version on top of this Privacy Policy.
